Drugs

In Howell, Fowlerville and elsewhere in Michigan, drug crimes can range from simple misdemeanors to felonies carrying penalties of up to life in prison. And if you have a prior drug conviction of any type, you could face double jail or prison time on a new drug charge. For example, you could have a prior misdemeanor possession of marijuana charge from 40 years ago that will double the maximum prison time on a new charge.

Even if your charge doesn't carry a prison sentence, the conviction of a drug crime can result in school financial aid ineligibility, school suspension or expulsion, disqualification from employment in many fields, loss of a current job and the forfeiture of your car, home, money or other personal property.

Protecting You From Unlawful Investigations

Many counties utilize drug teams like MAGNET, LAWNET, BAYNET, FANG, TNT, and Tri-County Metro to aggressively seek out, set up, and arrest suspected drug dealers and users. These teams frequently get people who are caught with drugs to turn on, set up or snitch on another person in exchange for possible leniency on their own pending case.

Sometimes, this involves an informant setting up a purchase of drugs from a large dealer. Sometimes, it involves entrapping a friend or relative who allows the informant to take one of the relatives' prescription pain pills because the informant's back might be hurting that day. Unfortunately, the rights of these informants as well as the targets of the drug teams are often trampled upon. If you face charges or criminal consequences following an investigation like this, we urge you to call us as soon as possible. We will work hard to protect your rights and fight for your future.

Medical Marijuana Laws

Voters in Michigan approved the use of medical marijuana in 2008 leading to the passing of the Michigan Medical Marijuana Act (MMMA). This law allows for prescription and use of marijuana for medical purposes under Michigan law. Medical use of marijuana is still prohibited under Federal law but is not always prosecuted. The MMMA establishes two groups of people who are permitted under Michigan law to utilize medical marijuana.

  • Patients who have been prescribed marijuana by a licensed physician are allowed to possess up to 2.5 ounces of marijuana and to grow up to 12 plants if the patient meets strict conditions for securing the growing plants.
  • Patient caregivers can also possess marijuana under Michigan law.

Both patients and caregivers must meet strict conditions to obtain protection under this law. There is a licensing procedure for both patients and caregivers that should be complied with in order to obtain legal protection. A person not complying with the registration, possession and growing procedures could jeopardize his or her legal protection. Contact our law office as soon as possible if you are facing criminal charges related to medical marijuana.
