How can a father establish paternity for his child?

In Michigan, establishing paternity is an important step for fathers who want legal rights to their child. Paternity determines a father’s responsibilities and rights, such as custody, visitation, and child support. Fathers can take different steps to establish paternity, depending on the situation.

Acknowledging paternity at birth

If the parents are unmarried, the easiest way to establish paternity is through the Acknowledgment of Paternity form. Both parents sign this form at the hospital after the child’s birth. This legally recognizes the father as the child’s biological parent. However, if one parent questions paternity, they can refuse to sign or request genetic testing.

Genetic testing

If there is any uncertainty about who the biological father is, genetic testing can confirm paternity. This test typically compares the father’s and child’s genetic material. A court can order this testing, or the parents can agree to it. Once the test is complete, the results establish paternity legally.

Court order for paternity

If the father is not listed on the birth certificate or if the parents disagree over paternity, either parent can request a court order to establish paternity. This process often includes DNA testing, and the court will issue a ruling based on the results. Once paternity is established, the father gains legal rights to the child, such as custody and visitation.

Voluntary acknowledgment after birth

Even if the father did not sign the acknowledgment form at birth, he can still establish paternity later by signing a Voluntary Acknowledgment of Paternity form. The father must file this form with the Michigan Department of Health and Human Services. He can do this until the child turns 18.

Establishing paternity benefits both the father and the child, offering emotional and financial support and legal rights. Taking steps to recognize paternity early can simplify future legal processes.
